Terms and Conditions

These Terms and Conditions (“Terms”) apply to your access to and use of Wilbest’s website, mobile application, EV charging platform, EV charging stations, payment services, Credit system, equipment supply, installation services, maintenance services, support services and any related products or services provided by Wilbest.
These Terms form an agreement between you and Wilbest Limited, trading as Wilbest (“Wilbest”, “we”, “us” or “our”).
By using our website, app, platform, EV charging stations or services, creating an account, purchasing Credits, starting a charging session, accepting a quote, purchasing equipment, or otherwise engaging with us, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services.
1. Definitions
In these Terms:
Account means a Wilbest user account created through our app, website, platform or another approved method.
App means the Wilbest mobile application or any mobile application used or operated by Wilbest for EV charging services.
Charging Station means an EV charging station, charger, connector, payment terminal or related equipment owned, operated, supplied, managed or made available by Wilbest or a third-party site owner through the Wilbest platform.
Charging Session means a charging transaction or attempted charging transaction using a Charging Station.
Credits means prepaid account credit purchased or issued for use on the Wilbest platform to pay for eligible EV charging services and related charges.
Guest User means a user who accesses a Charging Station without creating an Account, where guest or contactless payment is available.
Platform means Wilbest’s EV charging software platform, app, website, payment system, charger management system, billing system and related technology.
Services means the products and services supplied by Wilbest, including EV charging, payment services, Credit services, installation, maintenance, monitoring, support, hardware supply, solar-related services and related services.
Tariff means the price, rate or fee applicable to a Charging Session, which may include energy-based charges, time-based charges, idle fees, overstay fees, parking-related fees, session fees, transaction fees, or other fees displayed or notified to you.
2. Eligibility and authority
You must be at least 18 years old to create an Account, purchase Credits, make payments, accept a quote, or use paid Services, unless you have the permission and supervision of a parent, guardian, employer, fleet administrator or other authorised account holder.
If you use our Services on behalf of a company, fleet, site owner, employer or another person, you confirm that you have authority to bind that person or entity to these Terms.
If you use a vehicle that you do not own, you confirm that you have permission from the vehicle owner to charge that vehicle and to incur any related charges.
3. Accounts
To use certain Services, you may need to create an Account. You agree to provide accurate, complete and up-to-date information.
You are responsible for keeping your login details secure. You are responsible for all activity, charges, Credit usage and transactions made through your Account, unless caused by Wilbest’s error or negligence.
You must notify us promptly if you believe your Account has been accessed without authorisation.
We may refuse, suspend, restrict or close an Account where we reasonably believe that the Account has been misused, contains false information, creates a safety or fraud risk, has unpaid amounts, breaches these Terms, or is otherwise necessary to protect our users, network, business or legal obligations.
4. Using Charging Stations
When using a Charging Station, you must:
Use the Charging Station only for charging a compatible electric vehicle.
Follow all instructions displayed on the Charging Station, app, website, payment terminal, signage, vehicle manual, or provided by Wilbest or the site owner.
Use reasonable care and skill when connecting, charging and disconnecting your vehicle.
Ensure your vehicle is safe, roadworthy, compatible with the charger, and able to accept the charging service.
Use the correct connector and charging method for your vehicle.
Not damage, misuse, tamper with, modify, block or interfere with any Charging Station, connector, cable, payment device, software, signage or site equipment.
Not use a Charging Station in a way that is unsafe, unlawful, excessive, fraudulent, abusive, or disruptive to other users or site operators.
Move your vehicle promptly when charging is complete, where required by signage, app notices, site rules or reasonable instructions.
Comply with all parking rules, site rules, access rules, time limits and instructions from the site owner or property manager.
You acknowledge that EV charging may be affected by vehicle settings, battery temperature, battery state of charge, charger capability, grid conditions, network conditions, site conditions, software performance, maintenance, outages, safety controls and other factors.
5. Charging availability and performance
We aim to provide reliable EV charging services, but we do not guarantee that every Charging Station will be available, operational, compatible with your vehicle, or able to deliver a particular charging speed at all times.
A Charging Station may be unavailable or restricted due to faults, maintenance, upgrades, network issues, grid limitations, site access restrictions, payment issues, safety reasons, misuse, third-party systems, or circumstances outside our control.
If you experience a fault or issue, please contact us as soon as reasonably possible and provide details of the Charging Station, time, issue, vehicle and any payment or Credit deducted.
6. Prices, Tariffs and fees
Tariffs may vary by Charging Station, site, connector, charging speed, time, energy usage, duration, user type, account type, promotion, fleet arrangement or other applicable pricing condition.
Applicable Tariffs will be displayed or made available through the app, website, Charging Station, QR code page, payment screen, signage or other approved method before or during the Charging Session.
Unless stated otherwise, prices are in New Zealand dollars and include GST where applicable.
We may update Tariffs from time to time. The applicable Tariff for a Charging Session is the Tariff displayed or notified at the time you start or authorise the Charging Session, unless there is an obvious error.
You are responsible for all valid charges incurred through your Account, RFID card, fleet account, payment method, vehicle token, QR code session or other authorised charging method.
7. Wilbest Credits
Wilbest may operate a prepaid Credit system. Under this system, you purchase Credits before using eligible EV charging services. Credits are then deducted from your Account when you use eligible Services.
Unless stated otherwise, one paid Credit represents NZD $1.00 of value for eligible Wilbest EV charging services.
Credits are not a bank deposit, do not earn interest, and are not a financial product. Credits may only be used for eligible Wilbest Services and cannot be sold, transferred, assigned or exchanged for cash, except as expressly set out in our Refund Policy or where required by law.
Paid Credits do not expire while your Account remains active, unless we clearly state otherwise and are permitted to do so by law. Promotional, bonus, free, goodwill or trial Credits may be subject to separate terms, expiry dates or usage restrictions, provided those terms are clearly stated and comply with applicable law.
We may deduct from your Credit balance any valid charges, including charging fees, session fees, idle fees, overstay fees, account-related fees, or other applicable charges.
If a Charging Session or other valid charge results in a negative Credit balance, failed payment, chargeback or unpaid amount, you must pay the outstanding amount. We may suspend or restrict your Account until the outstanding amount is paid.
Credit balances are refundable only in accordance with our Refund Policy.
8. Payment methods
We may accept payment by credit card, debit card, online payment, bank transfer, fleet account, contactless payment, QR code payment, prepaid Credit, or other approved payment methods.
By adding or using a payment method, you confirm that you are authorised to use that payment method and that the information provided is accurate.
Payments may be processed by third-party payment providers. Additional payment provider terms may apply.
We may decline, cancel, suspend or reverse a transaction where payment authorisation fails, fraud is suspected, the payment method is invalid, or we are required to do so by our payment provider, bank or law.
9. Guest and contactless charging
Where available, Wilbest may allow Guest Users to access Charging Stations without creating an Account, using QR code payment, contactless card payment, PayWave, payment terminal or another approved method.
Guest charging may not be available at all locations or at all times.
Guest charging may require payment authorisation, pre-authorisation or a payment hold. Any unused authorised amount will be released in accordance with the payment provider’s or card issuer’s processes. Wilbest is not responsible for delays caused by your bank, card issuer or payment provider.
Guest Users may have limited access to historical session data, receipts, promotions, loyalty features, fleet features, Credit balances or account-based support tools.
10. Idle fees, overstay fees and site rules
Some Charging Stations or sites may apply idle fees, overstay fees, time-based charges, parking rules, towing rules, access limits or penalties if your vehicle remains connected or parked after charging is complete or outside permitted use.
You are responsible for reviewing and complying with all app notices, signage, site rules and parking conditions.
Wilbest is not responsible for parking fines, towing costs, infringement notices, site penalties or other costs imposed by a site owner, parking operator, council, enforcement agency or third party, unless caused by Wilbest’s proven error.
11. Fleet, business and site partner accounts
Fleet, business, property, landlord, body corporate, commercial or site partner arrangements may be subject to additional written terms, pricing schedules, service levels, reporting terms, billing arrangements or agreements.
If there is any inconsistency between these Terms and a separate written agreement signed by Wilbest, the signed written agreement will prevail to the extent of the inconsistency.
Fleet administrators may have access to certain information about charging sessions, users, vehicles, costs and account activity linked to the fleet account.
12. Equipment supply and installation
Where Wilbest supplies EV charging equipment, accessories, solar equipment, electrical services, installation, maintenance or related services, the scope, price and timing will usually be set out in a quote, proposal, invoice, order form or written agreement.
Unless otherwise agreed in writing:
Quotes are valid only for the period stated in the quote.
Installation dates are estimates and may depend on equipment availability, site access, weather, electrical requirements, approvals, network conditions and other factors.
You must provide safe and reasonable access to the site and ensure that an authorised adult is available where required.
You must provide accurate site information and notify us of any hazards, restrictions, body corporate rules, landlord requirements or consent requirements.
Variations, additional works, switchboard upgrades, trenching, civil works, network upgrades, permits, travel, after-hours work or unexpected site conditions may result in additional charges.
Ownership of supplied equipment passes to you only when payment is received in full, unless otherwise agreed in writing.
Risk in equipment may pass on delivery or installation, depending on the terms of the quote or invoice.
Manufacturer warranties may apply in addition to your legal rights.
13. Consumer rights
Nothing in these Terms limits, excludes or modifies any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, or any other law that cannot be lawfully excluded.
If you acquire goods or services from us for business purposes, you agree that, to the maximum extent permitted by law, the Consumer Guarantees Act 1993 does not apply to those goods or services, and that it is fair and reasonable for the parties to be bound by this exclusion.
14. Refunds, billing disputes and corrections
Refunds, billing disputes, Credit balance refunds, payment errors and service failure claims are handled in accordance with our Refund Policy.
If you dispute a charge, payment, Credit deduction or Charging Session, you should contact us within 30 days of the relevant transaction or session, unless a longer period is required by law.
You must provide enough information for us to investigate, including your account details, Charging Station location, date and time, vehicle, session reference, payment reference, screenshots, receipts or other relevant evidence.
We may issue a refund, Credit adjustment, replacement service or other remedy where appropriate and required by law.
15. Account closure
You may stop using our Services at any time. If you wish to close your Account, please contact us or use the account closure function if available in the app.
Deleting the app from your device does not automatically close your Account or cancel outstanding obligations.
You remain responsible for all valid charges incurred before your Account is closed.
If you have unused paid Credits when your Account is closed, you may request a refund in accordance with our Refund Policy.
16. Suspension and termination
We may suspend, restrict or terminate access to your Account, the Platform, Charging Stations or Services if we reasonably believe that:
You have breached these Terms.
You have provided false, misleading or incomplete information.
You have failed to pay an amount owed to us.
You have reversed, disputed or charged back a valid payment.
Your use creates a safety, security, fraud, technical, operational or legal risk.
You have misused a Charging Station, parking bay, connector, RFID card, payment method, promotion or Credit system.
Your Account has been inactive for an extended period and we are unable to contact you.
We will take reasonable steps to notify you unless it would be unlawful, unsafe, impractical, or inconsistent with our fraud prevention, security or legal obligations.
17. Intellectual property
All intellectual property rights in our website, app, Platform, software, content, branding, logos, designs, text, graphics, data, documentation and systems belong to Wilbest or our licensors.
You may use our website, app and Platform only for normal personal, business, fleet or site partner use in accordance with these Terms.
You must not copy, modify, reverse engineer, decompile, scrape, resell, frame, interfere with, or create derivative works from our website, app, Platform, software or content, except where permitted by law or authorised by us in writing.
18. Privacy
We collect, use, store and disclose personal information in accordance with our Privacy Policy.
By using our Services, you agree to the collection and use of your personal information as described in our Privacy Policy.
19. Limitation of liability
To the maximum extent permitted by law, Wilbest will not be liable for any indirect, consequential, special, incidental, loss of profit, loss of revenue, loss of data, loss of opportunity, loss of goodwill, or business interruption loss arising from or related to your use of our Services.
To the maximum extent permitted by law, Wilbest is not liable for loss or damage caused by:
Your failure to follow instructions, signage, vehicle manuals or site rules.
Vehicle defects, incompatibility, battery limitations or vehicle settings.
Faults or outages caused by third-party systems, payment providers, networks, electricity supply, site owners, mobile coverage or internet services.
Parking fines, towing, site penalties or enforcement actions not caused by Wilbest’s proven error.
Unauthorised use of your Account, RFID card, payment method or vehicle token where you failed to keep your account secure.
Events outside our reasonable control.
Where Wilbest’s liability cannot be excluded, our liability will be limited to the maximum extent permitted by law.
20. Indemnity
You agree to indemnify Wilbest for any loss, cost, claim, damage, liability or expense arising from your breach of these Terms, misuse of our Services, unauthorised use of a Charging Station, damage to equipment, failure to pay valid charges, or unlawful conduct, except to the extent caused by Wilbest’s negligence or breach of law.
21. Changes to these Terms
We may update these Terms from time to time by publishing the updated version on our website or app.
If we make material changes, we will take reasonable steps to notify you. Your continued use of our Services after the updated Terms take effect means you accept the updated Terms.
22. Governing law
These Terms are governed by the laws of New Zealand. The courts of New Zealand have non-exclusive jurisdiction over any dispute relating to these Terms or our Services.
